Agreement to Terms

By accessing and using the EkrIo Fitness mobile application (the “App” or “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and EkrIo Fitness, operated by Inflexience Technologies (“Company,” “we,” “our,” or “us”).

Account creation is free; subscription required for app access

EkrIo Fitness is available worldwide with full compliance across all major privacy jurisdictions.

Our performance-only data approach ensures compliance with GDPR, CCPA, PIPEDA, LGPD, and other privacy regulations worldwide.

Performance Training Disclaimers

Training Analytics Service

EkrIo is a performance analytics platform, not a medical service

• We provide training analytics and performance tracking
• We do not collect health data or provide medical advice
• Consult healthcare professionals for medical guidance
• Our AI generates training programs based on performance data only

Training Responsibility

You are responsible for training safely and within your abilities

• Use proper form and appropriate weights for your fitness level
• You assume all risks associated with training activities
• Stop exercising if you experience pain or discomfort
• Our platform tracks performance, not health status

Subscription Model and Pricing

Hard Paywall Model

• Free account creation and onboarding only
• Premium subscription required to access the App
• No free tier or limited features - pay or cannot use
• All billing handled through Apple App Store or Google Play Store

Pricing Structure

• Standard pricing: $15.99/month or $191.88/year
• Early adopter pricing: $11.99/month (locked forever unless cancelled)
• Launch discounts may be available for limited periods
• Subscriptions auto-renew unless cancelled

Cancellation & Billing

• Cancellation available through EkrIo app or your app store
• Continue using app until current billing period ends
• No partial refunds for unused time in billing cycle
• Refunds subject to Apple/Google Play Store policies only
• Early adopter pricing lost if subscription cancelled

Prohibited Activities

You agree NOT to:

✗Use the App for any illegal or unauthorized purpose

✗Interfere with or disrupt the App's functionality or AI systems

✗Attempt to gain unauthorized access to our systems or data

✗Upload malicious software, viruses, or harmful content

✗Share false or misleading training data

✗Abuse, harass, or harm other users in social features

✗Use the App for commercial purposes without permission

✗Reverse engineer, decompile, or disassemble the App

✗Attempt to circumvent the subscription paywall

✗Misuse AI-generated workout content for redistribution

Limitation of Liability

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

Our total liability to you is limited to the amount you paid for subscription services in the 12 months preceding the claim.

Termination

Termination by You

• Cancel subscription through EkrIo app or your app store
• Continue using app until current billing period expires
• Delete account separately if desired
• Early adopter pricing lost upon cancellation

Termination by Us

We may terminate your account for violation of these Terms, illegal activity, or non-payment of subscription fees.
